IMPORTANT: THESE TERMS CONTAIN A BINDING INDIVIDUAL ARBITRATION AGREEMENT, CLASS-ACTION WAIVER, JURY-TRIAL WAIVER, LIMITATIONS OF LIABILITY, AND A ONE-YEAR CONTRACTUAL CLAIM PERIOD. PLEASE READ THE DISPUTE RESOLUTION SECTION CAREFULLY. YOU MAY OPT OUT OF ARBITRATION WITHIN 30 DAYS.
Agreement and Scope
These Terms of Service (“Terms”) are a binding agreement between you and Lester Health LLC (“Lester,” “we,” “us,” or “our”). They govern your access to and use of lesterhealth.com and any related pages, accounts, content, communications, products, subscriptions, text-message programs, and services (collectively, the “Services”).
By accessing or using the Services, creating an account, submitting an order, enrolling in a program, or otherwise indicating acceptance, you agree to these Terms and the policies incorporated by reference. If you do not agree, do not use the Services.
Our Privacy Policy explains how we process personal information. Our Purchase Options Cancellation Policy applies to recurring orders. Our Shipping Policy and Return and Refund Policy apply to fulfillment, returns, and refunds. If a product page or checkout disclosure conflicts with these Terms regarding price, quantity, or renewal frequency, the more specific disclosure presented at purchase controls for that transaction.
Eligibility and Territory
You must be at least 18 years old, have legal capacity to contract, and use the Services only for lawful personal or household purposes. Sales are offered only for delivery within the United States. We may refuse, limit, suspend, or cancel access or orders where we reasonably believe these requirements are not met.
Accounts and Security
You are responsible for providing accurate and current information, safeguarding credentials and one-time login links, all activity under your account, and promptly notifying us of suspected unauthorized use. You may not impersonate another person, create accounts through automated means, or use another person’s payment method without authorization.
We may require identity or payment verification, suspend an account, delay fulfillment, or cancel an order to prevent suspected fraud, abuse, chargebacks, diversion, unauthorized resale, or legal violations.
Product Information and Availability
We try to describe products accurately, but packaging, appearance, ingredient sourcing, and other non-material details may vary. Images are illustrative. Product availability, offers, quantities, and purchase limits may change without notice.
We may correct errors, reject or cancel orders, limit quantities, discontinue products, or refuse service before shipment. If we cancel a paid order, we will refund the amount charged for that order.
Products are sold only for personal or household use. Resale, export, marketplace diversion, unauthorized distribution, and attempts to evade purchase limits are prohibited. A purchase does not grant any distribution, endorsement, or resale right.
Prices, Payment, and Taxes
Prices are shown in U.S. dollars and may change prospectively. One-time orders are currently $65 plus the shipping charge displayed at checkout and applicable taxes. The current subscription price is $39 for the first order, then $49 every 28 days, with standard subscription shipping included, plus applicable taxes. The checkout page controls if it displays a different clearly disclosed offer or promotion.
You authorize Lester and its payment providers to charge the payment method you provide for all amounts displayed and agreed at checkout. You are responsible for applicable sales, use, excise, and similar taxes. We will collect taxes where required.
Promotional codes have no cash value, may be subject to restrictions, may not be combined unless stated, and may be withdrawn or rejected for suspected misuse. Obvious pricing, typographical, or system errors do not bind us.
Subscriptions
Subscriptions automatically renew and are governed by our Purchase Options Cancellation Policy. Before you submit a subscription order, we display the recurring price, frequency, shipping treatment, cancellation methods, and other material terms near the order button and obtain your affirmative agreement.
You may cancel through your online account or by emailing help@lesterhealth.com before the next renewal is processed. A cancellation stops future renewals but does not reverse an order already processed. Eligible subscribers may skip or pause shipments through their accounts.
Returns and Refunds
Returns, refunds, the first-order guarantee, damaged products, and refund exclusions are governed by our Return and Refund Policy. Subscription renewals are nonrefundable after processing except where required by law.
Health and Supplement Notice
Lester products are dietary supplements, not drugs. They are not intended to diagnose, treat, cure, or prevent any disease. Statements concerning dietary supplements have not been evaluated by the U.S. Food and Drug Administration unless expressly stated otherwise. FDA does not approve dietary supplements before sale.
The Services provide general educational and product information only, not medical advice, diagnosis, or treatment. Lester does not guarantee any cholesterol reduction or other result. Individual results vary. Do not use a Lester product as a substitute for prescribed medication, professional medical advice, diagnosis, or care. Never stop or change medication based on our content.
Use products only as directed on the label. Before use, consult a qualified healthcare professional if you take medication, are pregnant or nursing, have a medical condition, are preparing for surgery, are under medical supervision, or have questions about ingredients, allergies, or interactions. Stop use and seek appropriate care if you experience a reaction.
For a medical emergency, call 911. To report a product complaint or adverse event, email help@lesterhealth.com with your contact information, product name, lot number if available, purchase date, and a description of the event.
No Professional Relationship
No communication through the Services creates a physician-patient, pharmacist-patient, dietitian-client, fiduciary, or other professional relationship. Calculators, quizzes, testimonials, research summaries, and generalized recommendations are informational estimates and are not individualized medical conclusions.
Acceptable Use
You may not:
- Violate law or another person’s rights;
- Interfere with the Services, their operation, or their security;
- Probe, scan, scrape, crawl, reverse engineer, or use automated systems without written permission;
- Introduce malware or harmful code;
- Harvest personal information;
- Manipulate reviews, referrals, promotions, or purchase limits;
- Submit fraudulent claims or initiate abusive chargebacks;
- Use the Services or their content to train or improve a competing model, service, or product; or
- Copy, frame, republish, sell, or commercially exploit the Services except as expressly permitted.
We may investigate suspected violations and preserve or disclose information as permitted by law.
Intellectual Property
The Services—including text, graphics, product names, trade dress, photographs, video, software, data, and compilations—are owned by or licensed to Lester and protected by intellectual-property laws. Subject to these Terms, Lester grants you a limited, personal, revocable, nonexclusive, nontransferable license to access the Services for lawful personal use. All rights not expressly granted are reserved. “Lester Health” and associated branding may not be used without written permission.
Customer Content, Reviews, and Feedback
If you submit a review, photograph, video, testimonial, social-media post, comment, idea, or other content to us, or tag or mention Lester in content you invite us to use (“Customer Content”), you represent that:
- You own or control the necessary rights;
- The content is truthful and reflects your genuine experience;
- Any material connection, discount, payment, gift, or incentive is clearly disclosed; and
- The content does not violate law or third-party rights.
You grant Lester and its affiliates, service providers, licensees, successors, and assigns a worldwide, perpetual, irrevocable, sublicensable, transferable, royalty-free license to host, store, reproduce, adapt, edit for length or format without materially changing meaning, translate, publish, display, perform, distribute, create derivative works from, and use Customer Content and your submitted name, likeness, voice, and social handle in any media for advertising, promotion, commerce, and operation of the Services.
To the extent permitted by law, you waive moral rights and similar rights. We are not required to use or compensate you for Customer Content. You may ask us to stop future advertising use by emailing help@lesterhealth.com. The request will not require recall of materials already produced or distributed where law permits.
Unsolicited feedback may be used without restriction or compensation. We may moderate or remove content but do not undertake to monitor all content.
Third-Party Services and Links
The Services may rely on or link to third parties, including Shopify, payment processors, subscription platforms, analytics, advertising, review, messaging, support, and delivery providers. Third parties operate under their own terms and privacy practices. Lester does not control and is not responsible for third-party services, content, availability, or acts, except to the extent responsibility cannot lawfully be excluded.
Copyright Complaints
If you believe content on the Services infringes your copyright, email help@lesterhealth.com with your signature; identification of the copyrighted work and challenged material; the material’s location; your contact information; a good-faith statement that the use is unauthorized; and a statement under penalty of perjury that your notice is accurate and you are authorized to act. Misrepresentations may create liability. We may remove challenged content and terminate repeat infringers.
Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” LESTER DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, QUIET ENJOYMENT, AND WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE.
WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS, OR THAT INFORMATION OR RESULTS WILL BE COMPLETE, ACCURATE, OR SUITABLE FOR YOU. PRODUCT WARRANTIES THAT CANNOT LAWFULLY BE DISCLAIMED REMAIN IN EFFECT.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LESTER AND ITS OWNERS, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES; LOST PROFITS, REVENUE, DATA, GOODWILL, OR OPPORTUNITY; OR THE COST OF SUBSTITUTE GOODS ARISING FROM OR RELATED TO THE SERVICES, PRODUCTS, OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THEIR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICES, PRODUCTS, OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID LESTER FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM DURING THE SIX MONTHS BEFORE THE EVENT, OR (B) $100.
These exclusions and limits apply under every theory of liability and allocate risk between the parties. They do not limit liability that cannot lawfully be limited, including where applicable liability for fraud, willful misconduct, or personal injury caused by legally nonwaivable conduct. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.
Indemnification
To the extent permitted by law, you will defend, indemnify, and hold harmless Lester and its owners, affiliates, personnel, agents, and service providers from third-party claims, losses, liabilities, damages, judgments, costs, and reasonable attorneys’ fees arising from your unlawful or unauthorized use of the Services, your Customer Content, your violation of these Terms, or your violation of another person’s rights.
This obligation does not apply to the extent a claim results from Lester’s own conduct for which indemnification cannot lawfully be required. We may control the defense and settlement of an indemnified matter. You may not settle it in a manner that admits liability or imposes obligations on us without written consent.
Dispute Resolution; Binding Individual Arbitration
Informal Resolution First
Before filing arbitration or litigation, the claimant must email a written Notice of Dispute to help@lesterhealth.com. The notice must include the claimant’s full name and contact information, account or order information, a detailed description of the dispute and supporting facts, the specific relief requested, and the claimant’s personal signature.
The parties will confer in good faith for 60 days after receipt. Any limitations period is tolled during this 60-day process. A party may seek temporary relief necessary to preserve the status quo.
Arbitration Agreement
Except for the exceptions below, you and Lester agree that every dispute or claim arising from or relating to the Services, products, communications, transactions, these Terms, or the parties’ relationship—including questions of arbitrability and claims arising before acceptance—will be resolved exclusively by final and binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, as modified by these Terms. The Federal Arbitration Act governs this agreement.
If AAA is unavailable, the parties will select a comparable administrator or a court of competent jurisdiction will appoint one. Arbitration may occur by video, telephone, documents, or in person as the rules and arbitrator permit. Judgment may be entered in any court with jurisdiction.
The arbitrator may award the same individual remedies a court could award, but only to the individual claimant and only to the extent necessary to resolve that claimant’s claim. The arbitrator must apply these Terms and governing law and issue a reasoned written award. Fees will be allocated under applicable AAA consumer rules, except a claimant must reimburse fees advanced because of a bad-faith or frivolous claim if the arbitrator so determines and law permits.
Exceptions
Either party may bring an individual action in small-claims court if it remains within that court’s jurisdiction. Either party may seek injunctive or equitable relief in court for actual or threatened infringement, misappropriation, or violation of intellectual-property, confidentiality, privacy, or security rights. Nothing prevents a party from reporting concerns to a government agency, and an agency may seek relief where authorized.
Class, Collective, and Jury Waivers
YOU AND LESTER AGREE TO BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY, NOT AS A PLAINTIFF, CLASS MEMBER, PRIVATE ATTORNEY GENERAL, OR REPRESENTATIVE IN A CLASS, COLLECTIVE, CONSOLIDATED, COORDINATED, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT COMBINE CLAIMS OF DIFFERENT PEOPLE OR PRESIDE OVER SUCH A PROCEEDING. YOU AND LESTER WAIVE THE RIGHT TO A JURY TRIAL.
If a final decision holds that a particular claim or request for public injunctive relief cannot lawfully be waived or arbitrated individually, that portion will be severed and litigated in court after all arbitrable matters are completed.
Coordinated Filings
If 25 or more substantially similar demands are submitted against the same party by or with coordinated counsel within 180 days, the demands will proceed in staged batches of up to 10, with one arbitrator per case, unless the parties agree otherwise. After each batch, counsel will confer in good faith regarding resolution and process improvements.
No remaining demand will be deemed filed or incur administrator fees until selected for a batch, and limitations periods for remaining demands are tolled from delivery of a compliant Notice of Dispute until selection. A court may enforce this staging provision. This provision does not authorize class arbitration and will not apply if the administrator or a court determines it prevents an individual claimant from effectively vindicating nonwaivable rights.
Thirty-Day Right to Opt Out
You may opt out of the arbitration agreement by emailing help@lesterhealth.com within 30 days after you first accept these Terms. Use the subject “Arbitration Opt-Out” and include your full name, mailing address, account email, and an unequivocal statement that you opt out.
Opting out affects only arbitration; all other Terms remain effective. An opt-out submitted by anyone other than you or your individually authorized agent is ineffective. If you previously accepted an arbitration agreement with Lester and did not opt out, a later opt-out applies only to materially new disputes, if any, covered solely by a later version.
Governing Law, Forum, and Claim Period
The Federal Arbitration Act governs arbitration. To the extent state law applies, Wyoming law governs without regard to conflict-of-law rules, except that mandatory consumer protections of your home state remain available where they cannot be waived.
Any court proceeding permitted under these Terms must be brought exclusively in the state courts located in Fremont County, Wyoming, or the U.S. District Court for the District of Wyoming, and each party consents to personal jurisdiction there, except an eligible small-claims action may be brought where law permits.
TO THE EXTENT PERMITTED BY LAW, ANY CLAIM MUST BE FILED WITHIN ONE YEAR AFTER IT ACCRUES OR IT IS PERMANENTLY BARRED. This period does not shorten any limitation period that cannot lawfully be shortened and is tolled during the required informal-resolution process.
Suspension and Termination
We may suspend or terminate access, cancel orders, or restrict accounts for suspected fraud, abuse, legal risk, prohibited conduct, or violation of these Terms. You may stop using the Services at any time, but stopping use does not by itself cancel a subscription.
Provisions that by their nature should survive—including payment, ownership, licenses, warranty disclaimers, liability limits, indemnification, disputes, and general terms—survive termination.
Changes to the Services and Terms
We may update the Services and these Terms prospectively. The “Last updated” date identifies the current version. For material changes, we will provide notice as required by law, such as by email or a prominent site notice. Changes do not retroactively alter a dispute that arose before the change.
Continued use after an effective date constitutes acceptance where permitted. Where affirmative consent is required, we will request it. Subscription price changes are governed by the Purchase Options Cancellation Policy.
General Terms
These Terms and incorporated policies are the entire agreement regarding their subject matter and supersede prior discussions. If a provision is unenforceable, it will be enforced to the maximum lawful extent or severed, and the remainder will continue. A failure to enforce is not a waiver.
You may not assign these Terms without our written consent. We may assign them in connection with a merger, financing, reorganization, sale of assets, or by operation of law. We are not liable for delay caused by events beyond reasonable control. Headings are for convenience. “Including” means “including without limitation.” Electronic records and signatures satisfy writing requirements.
SMS Program Terms
If you affirmatively enroll, Lester may send recurring automated marketing text messages to the mobile number you provide, including product, promotional, and cart-reminder messages. Consent is not a condition of purchase. Message frequency varies. Message and data rates may apply. Mobile carriers are not liable for delayed or undelivered messages.
By enrolling, you represent that you are at least 18, are the subscriber or customary user of the number, and authorize messages using automated technology. If a number is reassigned, the former user’s consent does not transfer.
Reply STOP to any marketing text to opt out. We may send one confirmation message. For assistance, reply HELP or email help@lesterhealth.com. After opting out, you may still receive nonmarketing texts you separately request or that are necessary for an active transaction where legally permitted. To re-enroll, complete a new consent flow.
We may change or discontinue the SMS program. SMS information is processed as described in our Privacy Policy. Mobile information and SMS consent will not be sold or shared with third parties for their own marketing where prohibited; disclosure to providers supporting our program is permitted. The dispute-resolution provisions of these Terms apply to the SMS program.
